Terms of Service
These Terms govern your use of Ember Audiobook Player (“Ember”), provided by Nestor Studios, Netherlands. By downloading or using Ember, you agree to these Terms. Mandatory consumer rights in your country continue to apply.
1. What Ember does
Ember is an Android player and organizer for compatible, locally stored, DRM-free audiobook and audio files. Ember does not provide, sell, host or stream audiobook content.
2. Permission to use Ember
Nestor Studios grants you a limited, personal, non-exclusive, non-transferable and revocable license to use Ember on compatible Android devices in accordance with these Terms and applicable store rules. Ember and its original software, design and branding remain the property of Nestor Studios or its licensors.
3. Your files and responsibilities
You keep ownership of your audiobook files, notes and other content. Nestor Studios does not claim ownership of them. You are responsible for ensuring that you have lawful rights to possess and use any files opened with Ember.
You must not use Ember unlawfully, interfere with its operation, distribute malicious modifications, attempt unauthorized access, or bypass purchase or entitlement controls. Ember does not intentionally alter, overwrite or delete source audio files, but you remain responsible for independent copies of important audio and exported data.
4. Local information, backups and removal
Ember stores library information, progress and settings primarily on your device. Clearing app data, uninstalling Ember, replacing a device, changing storage, losing folder access or restoring an incomplete backup can remove or disconnect this information. Manual backups exclude audio files and folder-access permissions, and restored folders may need to be reconnected. Android system backup or device transfer may operate separately according to your device settings and provider.
5. Premium purchases
Ember Premium is an optional one-time Google Play in-app purchase, not a subscription. The localized price and included features shown in Ember and Google Play at the time of purchase apply. Google Play processes payment, ownership restoration and eligible refunds under its rules and applicable law. A purchase or restore may require a supported Google account, internet connection, Google Play services and compatible device.
6. Advertising and third-party services
The free version may display Google AdMob banner advertising. Premium removes Ember's ads. Google AdMob, Google's User Messaging Platform, Google Play Billing, Android, device manufacturers, backup providers and storage providers may supply services used with Ember. Their terms and privacy policies apply to those services. See Ember's Privacy Policy for more information.
7. Compatibility and updates
Devices, Android versions, codecs, storage providers, metadata, artwork and folder arrangements vary. Nestor Studios does not guarantee compatibility with every device, audio file, provider or import structure. Corrupt, inaccessible, unsupported or DRM-protected files may not work, and metadata, artwork, chapter or folder recognition may be incomplete.
Ember and its features may be corrected, improved, changed or removed through updates. Such changes do not remove rights you have under mandatory consumer law.
8. Availability, warranties and reasonable limits
We aim to keep Ember dependable, but uninterrupted or error-free operation cannot be guaranteed. To the extent permitted by law, Ember is provided without warranties beyond those required by law, and Nestor Studios is not liable for indirect or consequential loss, loss caused by unsupported or damaged files, loss of local app data, third-party services, device or storage failure, user action, or circumstances outside reasonable control.
Nothing in these Terms excludes or limits liability or consumer protections that cannot legally be excluded or limited.
9. Suspension and termination
You may stop using Ember at any time by uninstalling it. Nestor Studios may restrict access to paid or app services where reasonably necessary to address fraud, unlawful use, security risks or a material breach of these Terms, subject to applicable law and Google Play rules.
10. Governing law and disputes
These Terms are governed by Dutch law. If you are a consumer, this choice does not remove mandatory protections or courts available under the law of your country of residence. Please contact us first so we can try to resolve a problem informally.
11. Changes and contact
We may update these Terms to reflect changes to Ember, law or service providers. The current version and update date will remain available on this page.
